🔒 Aatio AI Agent – Subscription Plan Terms & Policies
By subscribing to the Aatio AI Agent Plan, you (the customer) agree to the following terms:
📆 Billing & Cancellation Policy

Monthly Billing: Subscriptions are billed monthly based on the selected plan at checkout. Applicable taxes may apply.

No Long-Term Contracts: Plans are billed month-to-month unless otherwise stated.

Cancellation: You may cancel at any time. The cancellation will take effect at the end of your current billing cycle. No partial refunds or prorated billing applies.

Billing Cycle: Your billing starts on the purchase date and renews automatically every 30 days unless cancelled.

Refund Policy: There are no refunds on plan fees or unused AI minutes.
💳 Pricing Adjustments

Aatio reserves the right to revise pricing to reflect changes in platform costs, service enhancements, or market conditions.

Clients will be notified in advance of any price changes.

New pricing will apply to the next billing cycle. Customers may cancel before renewal if they do not wish to continue under the new rates.
🔄 Turnaround & Update Requests

Standard Response: Aatio aims to respond to all inquiries within 72 hours.

Estimated Timelines: Aatio will inform you of the estimated time required for any requested update.

Time Variations: Each update may vary in complexity and timing. Clients will be kept informed throughout the process.
🧠 Usage Limits & Overages

AI Minutes: Any usage beyond plan limits will be billed separately.

AI Agents: The number of AI agents is limited based on your current plan.

Overusage: Any overage in AI usage or agent limits will be charged additionally and clearly stated in your invoice.
🔧 Integrations & Customizations

Plan-Based Integration: Some plans include one standard integration. If your plan does not, integrations can be added for an additional fee.

Flexible Options: We offer integrations through Zapier, webhooks, and direct APIs.

Scope Review: Custom integration requests are reviewed on a case-by-case basis for cost and feasibility.
📞 Phone Number Policy

Each subscription includes one virtual phone number for inbound/outbound calls.

Phone numbers are provisioned via third-party platforms (e.g., Twilio) and may not be transferable due to platform limitations.
🔐 Data Handling & Confidentiality

Client Data: You may share contact data, workflows, or business information for setup. Aatio will not use this data without your written request.

Security: Data is stored securely using industry-standard measures. Components are hosted on AWS (USA), in GDPR- and ISO27001-compliant environments.

Client Responsibility: You are responsible for the integrity and lawful collection of the data you share.

Data Deletion: Aatio will permanently delete client data upon written request.
⚠️ System Uptime & Third-Party Dependencies

Aatio relies on platforms such as OpenAI, Twilio, Dialogflow, Cal.com, GHL, and Wix.

We are not liable for service disruptions caused by third-party outages.

We will notify you of any planned outages and will act promptly in the case of unplanned disruptions.
🛑 Service Suspension

Aatio reserves the right to temporarily suspend services due to policy violations, misuse, security concerns, or non-payment.
📈 Fair Usage Policy

To ensure system stability, Aatio applies a fair usage policy. Accounts with excessive or abusive use may be subject to throttling, plan upgrades, or review.
🔐 Right to Refuse Service

Aatio reserves the right to decline service, onboarding, or renewal of any customer at its sole discretion, especially in cases that may conflict with legal, ethical, or operational standards.
📚 Intellectual Property

All custom scripts, workflows, integrations, and proprietary tools built by Aatio remain the intellectual property of Aatio unless agreed otherwise in writing.
📢 Marketing Use (Optional)

Unless requested otherwise in writing, Aatio may use your logo or company name in promotional material, case studies, or its website to highlight successful implementations.
🧾 Client Onboarding Responsibility

Timely onboarding depends on your sharing of necessary content, access, or approvals. Delays on your end may affect the service timeline.
⚖️ Liability & Indemnity

Aatio is not liable for:

Indirect, incidental, or consequential losses

Platform outages by third parties
-
Errors caused by incorrect data or client misconfiguration

Indemnity: You agree to indemnify and hold Aatio harmless from any losses or legal issues resulting from:

Your use or misuse of the AI agent

Unlawful or unauthorized use of shared data
-
Violations of third-party terms or local laws

🧾 Acceptable Use Policy

You may not use Aatio’s services for spam, harassment, illegal activity, or unethical practices. Violations may result in suspension or termination.
⏱️ Support SLA

Aatio aims to respond to all support requests within 72 business hours.
⚠️ Force Majeure

Aatio will not be held responsible for delays or failures due to circumstances beyond its control, including natural disasters, outages, or acts of war.
🧭 Jurisdiction & Dispute Resolution

These terms are governed by the laws of the Province of New Brunswick, Canada.

In case of a dispute, both parties will first attempt to resolve the matter in good faith before pursuing legal action.
📄 Modifications to Terms

Aatio may update these policies from time to time. Material changes will be communicated in advance and take effect from the start of your next billing cycle.
